8.5.3 Customer Property

    I work for a shipping company where we ship via vessels and trucking.... customer property is in our care but not used by our organization. Does this clause apply to us? I’m only thinking yes because it is in our control to an extent

    What are you shipping? It's customer property! You cannot, therefore, avoid the requirements in 8.5.3.

    I'm just curious that you're asking a question that there's an obvious answer. Have you encounter someone with a dissenting answer?

    SEGKnight, similar organisation...
    I have this covered with our WMS tag system, non-conform products/situations instructions and registration (eg goods are checked on damages on intake, regular rounds, departure... when not conform: isolate, notify customer, ...) , security measures (door alarms, cameras and such) , CMR procedures ...

    Wouldn't this depend on the FOB terms? Who owns the goods and at what point ownership/liability changes?

    Ellie,

    the transporter or logistic service provider very rarely becomes owner of the goods.
    And there should be no difference in care whether the goods belong to the sender or the receiver. The only difference is who will be billed for what...
